Plan Check Requirements

Application for Permit

Plan Check Expiration

Applications for which no permit is issued within twelve (12) months following the date of application shall expire by limitation and plans and other data submitted for review may thereafter be returned to the applicant or destroyed by the building official. In order to renew action on an application after expiration, the applicant shall resubmit plans and pay a plan review extension fee. A plan review extension is valid for the same duration as a new application and may be renewed in the same manner as a new application. No application shall be extended after six months from expiration. Approval of plan check extension is subject to the building official review and acceptance.

The plans submitted for the plan review extension shall comply with the technical codes and other applicable city, county, and state regulations in effect at the time the plan review extension is granted. The plan review extension shall be requested on a modification form and an adequate fee shall be charged.

Permit Expiration

A permit will expire in two conditions:

  • Every permit issued by the building official under the provisions of the technical codes shall expire and become null and void, if the work authorized by such permit is not commenced within twelve (12) months from the date of such permit. Before such work can be recommenced, a renewed permit shall be obtained to do so, and the fee therefore shall be one additional inspection fee, provided no changes have been made or will be required in the previously approved plans and specifications for such work; and provided further that the previous permit has not expired for more than six months.
    If changes to the plans or specifications are required in order to comply with the technical codes and other city, county, and state regulations effective at the time of renewal, a plan review fee of the amount as required for a plan review extension shall be paid and re-submitted to plan check. No permits shall be renewed after six months from the expiration. If the plans have been revised and deviate substantially from the previously approved plans in scope or in design, as determined by the building official, the application shall be processed as for a new project.
  • The building official is authorized to suspend or revoke a permit issued under the provisions of this code wherever the permit is issued in error or on the basis of incorrect, inaccurate, or incomplete information or in violation of any ordinance or regulation or any of the provision of this code.

For the purpose of this section, the first recorded inspection approval constitutes commencement of work.

Incomplete Construction

When a permit expires by time limit or is revoked, the incomplete construction for which the permit is issued shall constitute a public nuisance and shall be abated in accordance with the procedure set forth in Title 15 chapters 15.08 and 15.32 of the Brea Municipal Code.
